1. Entering a contract

a / No contractual relationship arises between Mrs. Viara Kelcheva, attorney, and a person who has merely submitted a query. By submitting a query, the attorney is only invited to respond with a proposal outlining her compensation related to the query;

b / The contract for provision of an online legal consultation is considered to be in place when the sender of the query confirms via regular mail or email that he/she agrees with the proposed fee and response deadline. Starting then, the sender of the query can claim a response from the attorney and the attorney can claim payment for her services rendered related to the online legal consultation.

2. Privacy

a / The attorney is obligated to keep confidential the information which has become known through her communication with the sender. Disclaimer: when transmitting information via email without using a digital signature, the confidentiality of the transmission cannot be ensured;

b / In cases when the sender submits an unencrypted query, the attorney may respond in the same way.

3. Terms of use and assignment of responsibilities

a / The attorney can analyze the submitted query to the extend sufficient information has been made available. Errors or discrepancies in the attorney’s response which are based upon inaccurate or distorted information do not result in any liability for the attorney. This does not apply if the attorney’s advice is found to have been intentional or a result of gross negligence;

b / Any liability for the attorney under the above circumstances is limited to BGN 500;

c / The attorney is obliged to refuse to provide legal advice if she is already representing the opposing side in the issue at hand.

4. Term

a / Should the attorney fail to designate an alternative period for replying to the submitted query prior to entering into a contract with the sender, she would be obliged to provide the requested legal advice in writing within three working days from the day following entering the respective contact;

b / Should the attorney fail to designate an alternative period for replying to the submitted query prior to entering into a contract with the sender, she would be obliged to provide the requested legal advice related to an existing lawsuit in writing via email in a PDF file format or via an uncertified copy through regular mail within three working days of receiving a copy of the case materials.

5. Expenses

a / The fees associated with providing an online legal consultation will vary based on the legal and factual complexity of the query submitted;

b / No payment is due for submitting an online query.

6. Payment

The law office of Mrs. Viara Kelcheva accepts bank transfer, postal order and еPay payments. The payment method selected by the sender of the online query must be declared in the notification sent to the attorney in case of acceptance of the proposed fee.
